South Dakota Gov. Noem Sends Transgender Sports Bill Back To Lawmakers for Style and Form Changes

South Dakota Gov. Kristi Noem (R) sent a bill banning transgender women from female sports back to lawmakers for changes in style and form.

“Unfortunately, as I have studied this legislation and consulted with legal experts over the past several days, I am concerned that the vague and overly broad language of this bill may have significant non expected consequences, “Noem said in a statement on Friday.

Noem cited Section 2 of the law which “requires a student athlete to prove, each year, that the student’ has not taken and has not taken, in the past twelve months, any performance-enhancing medications , including anabolic steroids. “

He argued that Section 2 places an “unenforceable administrative burden on schools” by collecting them “verification forms from each student-athlete, each year, according to age, biological gender, and use of performance -enhancing drugs. ”

Noem expressed concern with the law because she did not believe it should be applied at the college level.

“South Dakota has shown that our student athletes can compete with anyone in the country, but competing on the national stage means following the national governing bodies that oversee athletic colleges,” Noem said.

He continued, “While I certainly don’t always agree with the actions that these tolerance bodies take, I understand that athletic colleges need such a system-a fifty-state patchwork is can’t be done. “

Noem concluded, “I support this legislation and I hope House Act 1217, along with the changes I propose, becomes law.”

Earlier this month, Noem announced his intention to sign the bill after it was passed by the South Dakota Senate by a 20-15 vote, as Reported by IJR.

“In South Dakota, we celebrate [International Women’s Day] by defending women’s sports! I am excited to sign this bill as soon as possible, ”Noem wrote on Twitter.

Noem’s announcement drew criticism from the Human Rights Campaign, “Trans girls and their families are your constituency. You are using your power to exclude children and make them feel inferior to , and that’s what no one can be proud of. “
